STANDARD TERMS AND CONDITIONS FOR THE SUPPLY OF GOODS OR SERVICES BY ANDISWA’S KITCHEN

 

A Client shall be obliged to adhere to the Standard Terms and Conditions for service (service also include product) as expressed hereunder.

 

SOLE AGREEMENT

Unless otherwise agreed in writing, these terms [Terms and each Term] and Andiswa’s Kitchen purchase order(s) [Order or Orders] represent the only conditions upon which Andiswa’s Kitchen procures services [the Services] specified in the Order from the person to whom the Order is addressed.  Andiswa’s Kitchen does not accept any other conditions which the Client may specify, unless otherwise agreed to by  Andiswa’s Kitchen in writing.  In the event of any inconsistency between these Terms and any Order, these Terms shall take precedence.

 

By using the Andiswa’s Kitchen website (s) the Client agrees to all the terms [Terms and each Term] listed below. Use of this website includes placing orders or any other service [the Services] Andiswa’s Kitchen may offer.

 

Please take special care when reading these. No employee, or affiliate to Andiswa’s Kitchen has the authority to overrule or change any of the Terms and Conditions.

 

  1. CONFORMITY WITH ORDER

Services shall conform strictly with the Order. The Client shall not vary the quantities specified and/or the specification, if any, stipulated in the Order, without the prior written consent of  Andiswa’s Kitchen.

A minimum of 2 working days is required for all orders unless otherwise agreed in writing.

 

DELIVERY AND TITLE

  • The delivery dates and addresses are those in the Order. Time shall be of the essence in respect of the Client and Andiswa’s Kitchen obligations under the Order.
  • Andiswa’s Kitchen will not be excused for delay in delivery or performance except due to circumstances outside its control and then only subject to the Andiswa’s Kitchen having notified a Client in writing on becoming aware of such circumstances. Andiswa’s Kitchen may terminate an Order, in whole or in part, without incurring any liability.
  • Risk of loss or damage to Goods shall pass to the Client on delivery, and title shall pass to the Client when payment to the Andiswa’s Kitchen has been effected.
  • If on delivery, the service does not conform to the Order, the Client may reject the Service(s) and Andiswa’s Kitchen shall promptly rectify any defects.
  • If on delivery, the perishable goods do not conform to the Order, the Client may reject the goods within 24hrs and Andiswa’s Kitchen shall promptly rectify any defects.
  • Andiswa’s Kitchen does not accept any return of unwanted perishable goods or mistaken (by the Client) orders of perishable goods.

 

 PRICE AND PAYMENT

  • Prices specified in an Order are subject to change. A non-refundable deposit of 50% is required to confirm booking of Andiswa’s Kitchen‘s private catering and cooking classes (other offerings are to be paid in full, 100% payment), and balance must be paid prior or on the date of service delivery. No delivery shall take place before outstanding balance has been settled in full.
  • Payment shall be made by Client in the South African currency and on the terms stated in the Order. International Clients are to contact Andiswa’s Kitchen for available payment options.
  • Payment can be made via the Card Machine, online (we use Payfast and YOCO) using the website and via EFT, NO Ewallet or Cash-send will be accepted. Cash payments are to be agreed on in writing between the Client and Andiswa’s Kitchen. No payment shall be regarded valid until  Andiswa’s Kitchen have received cleared funds. Any amounts due in terms of these Terms shall be paid to Andiswa’s Kitchen, considering any deduction or set-off and bank charges.

 

TERMINATION OF ORDER

    • Andiswa’s Kitchen may cancel an Order in whole or in part at any time upon at any time with written notice to the Client, when the Client commits any serious breach or any repeated or continued material breach of its obligations under these Terms and/or Order or shall have been guilty of conduct tending to bring Andiswa’s Kitchen into disrepute.
    • In the event of termination Andiswa’s Kitchen must submit all claims to the Client and Client must pay the amount claimed within 7 days.
  • Only order amendments or cancellations which are given at least 7 working days before the intended delivery date will be accepted otherwise the Client will have to pay full amount of the order. Orders placed or cancelled on weekends (Saturday or Sunday) or Public Holidays will be treated as having been received on the following working day.

 

NOTICES

    • Notices under these Terms shall be delivered by hand to the relevant addresses of the parties in the Order or may be served by facsimile or by email, in which event notice shall be deemed served on acknowledgement of receipt by the recipient.

Dissatisfaction and Feedback

    • If the Client is dissatisfied with any part of the received goods and/or our customer service, please do not hesitate to contact Andiswa’s Kitchen directly, by email, Website contact form, WhatsApp or call.
    • We do appreciate any constructive criticism or suggestions of service and goods.
    • Please inspect all perishable goods upon delivery. If the Client find the goods is not up to quality standards or the packaging has been damaged during delivery or leaking due to damage of packaging, please contact us within the same day (24hrs) of delivery. Please take a picture of the defect to email or WhatsApp Andiswa’s Kitchen and also keep the goods as received.
    • We will not refund or exchange any goods if the Client have eaten it.

 

Our Ingredients

Our basic ingredients include sugar, eggs, salt, wheat, dairy products, butter and\or may contain traces of nuts. If the Client wish to enquire ingredients before placing an order please email us at hello@andiswaskitchen.com.  Allergens (nuts, milk, gluten, wheat, soya) may be present in our products unless otherwise stated. For diet requirements please mention them on the booking form or by email, WhatsApp or call before placing an order.

 

Perishable Goods, Freezing and Defrosting

  • We advise that the Client store Andiswa’s Kitchen baked goodies in the packaging provided in or Clients may transfer baked products into an air tight container and keep in a cool room and DO NOT place in the fridge or freezer, unless advised otherwise. Where Clients refrigerate our baked goodies, it is advised that Clients let the goodies thaw for at least an hour or two hours before consuming.
  • Our home cooked food is delivered fresh, if the Client wish to freeze, please do so on the same day of purchase or delivery. To defrost the meal, leave it in the refrigerator over-night before reheating it into the oven or microwave. Our home cooked food does not contain preservatives, therefore food taste after freezing may vary from the meal eaten fresh. Additionally, we use fresh vegetables in 99% of our meals, thus the Client may experience meals that may go slightly watery as there are no preservatives used.
  • It is not advisable to refreeze defrosted or thawed meals. After defrosting any meal, refrigerate leftovers to eat within 48hrs. Again, the taste may not be the same and freshness may disappear.

 

GENERAL

    1. Completion or termination of an Order shall be without prejudice to any Term herein which by its nature would be deemed to continue after completion or termination.
    2. Headings are included herein for convenience only. If any Term herein be held illegal or unenforceable, the validity or enforceability of the remaining Terms shall not be affected.
    3. All rights and remedies available to either party under these Terms shall be in addition to, not to the exclusion of, rights otherwise available at law.
